Through delegated authority from the Secretary of State, the Deputy Governor and his office are responsible for processing applications for persons seeking to be Naturalised or Registered as British Overseas Territories Citizens, a process which is governed by the British Nationality Act.
Therefore, the Office of the Deputy Governor is the data controller in respect of Personal Data received and processed for these applications.
We are committed to protecting your privacy and Personal Data. This Privacy Notice will explain how we use the personal data we collect from you when you submit information to us.
"Personal Data" includes any information that can be used to identify you or that we can link to you as an individual.
We collect your Personal Data when you provide it to us, which may include, but is not limited to:
- Full name, date and place of birth, age, gender, nationality, marital status, passport photo page;
- Birth certificates of the applicant, and birth certificates of the applicant's parents and spouse of the applicant, as needed and applicable, to confirm citizenship, identity and personal details;
- Contact information, including physical address, postal address, email address and telephone number;
- Employment details, which may include Employer and job title; and
- Immigration status.
We collect Personal Data from the Workforce Opportunities and Residency Cayman (WORC), including:
- confirmation that you satisfy the residency requirements for the British Nationality Act.
We collect Sensitive Personal Data from the Royal Cayman Islands Police Service (RCIPS) and WORC, to satisfy the Good Character requirements of the British Nationality Act, which may include adverse information such as, but not limited to, the following:
- the data subject's commission, or alleged commission, of an offence; or
- any proceedings for any offence committed, or alleged to have been committed, by the data subject, the disposal of any such proceedings, or any sentence of a court in the Cayman Islands or elsewhere.
We collect personal references from two persons identified by you to act as your referees, to satisfy the requirements of the British Nationality Act.
Why we collect your Personal Data
We collect certain Personal Data for the purpose of processing applications for Naturalisation and Registration as a British Overseas Territories Citizen.
The Personal Data we collect enables us to verify the identity and background of applicants and to confirm that the various requirements of the British Nationality Act have been met. This is to ensure that applicants are eligible to be Naturalised or Registered as British Overseas Territories Citizens, and also to prevent fraud.
How we keep your Personal Data safe
We take appropriate technical and organisational measures to keep your Personal Data secure, in accordance with our internal policies and procedures regarding storage of, access to and disclosure of Personal Data. We may keep your personal data in our electronic systems or paper files.
When you submit the BOTC Naturalisation or Registration application form and supporting documentation or other personal data using this system, the data contained within the form is encrypted. The data is also encrypted when it is stored on our servers.
The only employees who are granted access to your Personal Data are those with a business 'need-to-know' or whose duties reasonably require such information.
Your Data Protection rights
We would like to ensure that you are fully aware of all of your data protection rights. Every user is entitled to the following:
- The right of access - You have the right to request copies of your personal data and other information related to our processing.
- The right to rectification - You have the right to request that we correct any information you believe is inaccurate, including to ensure it is complete or up to date.
- The right to stop or restrict processing - You have the right to request that we cease the processing of your personal data, under certain conditions.
- The right to complain - You have the right to complain to us or to the Ombudsman if you believe we are processing your personal data in a way that breaches the Cayman Islands Data Protection Law 2017.

How you can access your Personal Data that we have collected
If you make a written request to review any Personal Data about you that we have collected, we will provide you with any such personal data, as permitted or required by law. You can submit your written request to foi.odg@gov.ky.
How long we use or keep your Personal Data
We will only use or keep your Personal Data for as long as necessary to fulfil the purposes for which it is collected, including to satisfy any legal, accounting, audit or reporting requirements.
Data entered and saved on this portal from your online application, but not submitted, will be deleted after 45 days of inactivity. Data contained in applications that have been approved will be removed from the portal 45 days after the decision has been made.
In accordance with the National Archive and Public Records Law, approved applications are retained permanently within the Office of the Deputy Governor or stored at the Cayman Islands National Archive. Applications which are "abandoned" are destroyed after three years, and applications which are not approved are destroyed two years after the end of the calendar year in which they were submitted.
Who has access to your Personal Data
Your name, date of birth and place of birth will be provided to other Government agencies consulted as part of a formal request by our office for additional background information.
The UK Home Office reserves the right to request details of persons who have been Naturalised as British Overseas Territories Citizens.
For applicants who subsequently decide to pursue registration as a British Citizen, a copy of your application will be forwarded to UK Home Office.

We may update the contents of this Privacy Notice from time to time to reflect any changes in the way in which we process your personal data or to reflect changing legal requirements. In case of updates, we will post the revised Privacy Notice here on our website.
